Notice Regarding the Filing of Non-Public Documents

After the recent disclosure of widespread cybersecurity breaches into the computer systems of the federal government, we are taking immediate action to reduce the risk of potential future compromises of Court filings containing confidential or business proprietary information (“non-public documents”).

Therefore, effective immediately, please do not file any non-public documents in CM/ECF.  The filing of a public version of a non-public document (consistent with USCIT Rule 5(g) and its “one-day lag” rule, if necessary) on CM/ECF will satisfy filing deadlines.  Because service of documents is normally effectuated by filing in CM/ECF, this notice also suspends all service requirements for non-public documents. 

Please note, we are not aware of any specific compromise of the Court’s CM/ECF system and are taking this action in an abundance of caution.  More information will be forthcoming regarding a new process for filing/serving non-public documents.
