If exhibits are filed electronically, an accompanying hard copy with proper Index and identifying tabs must also be filed with the court. Please note that as of October 19, 2009, Judge Barzilay requires that in all cases the Parties must prepare and file a Joint Appendix which complies with Federal Circuit Rule 30 within seven days after the filing of the final reply brief. The Parties need only file with the court and serve on other parties one copy of the confidential and public appendices.

Please note that as of October 19, 2005, all assertions of law, references to the record, and factual conclusions stemming from the record must have proper, clear citations or be deemed waived. This rule will be strictly applied with respect to references to administrative records.

Please also note that effective as of October 20, 2003, Judge Barzilay’s chambers rules require that all briefs submitted contain a Table of Contents and Table of Authorities, as well as a Summary of Argument.

Hiring Policies for Law Clerks

One clerk hired each year for two-year clerkship. Applicants must submit cover letter with law school transcripts, two letters of recommendation and one writing sample.  Please note that letters of recommendation sent under separate cover should bear the name of the law student on the outer envelope.  Applicants with extensive writing experience and an interest in international trade law are preferred. It is suggested that applicants read the article "Litigation Before the United States Court of International Trade" written by former Chief Judge Edward D. Re, found in the first volume of Title 19 of the United States Code annotated, published by the West Group. Applications are accepted after Labor Day for students having completed their second year of law school.
